Terms of Service

These Terms of Service ("Terms") govern your use of the Deskbudi application for Windows, this website and any related services (together, the "Service"). The Service is operated by Li Qiaoming, trading as Deskbudi Studio, Room 802, Building 27, Zone 3, Xikeng New Village, Fucheng Subdistrict, Longhua District, Shenzhen, Guangdong Province, 518110, China (email: aken123de@163.com) ("Deskbudi", "we", "us").

By downloading, installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you need the consent of a parent or guardian.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, for personal, non-commercial use. You may not:

• copy, sell, rent, sublicense or redistribute the Service or any artwork, audio or content bundled with it;
• reverse engineer, decompile or modify the Service, except to the extent allowed by mandatory law;
• remove or alter any copyright, trademark or ownership notices;
• use the Service to build a competing product or to train machine-learning models.

3. Purchases and payment

The application is free. Optional characters, plants, passes and in-app items are sold as one-time purchases. Prices are shown in US dollars before you pay.

Payments are processed by Creem, which acts as our Merchant of Record. That means Creem is the seller of record for your purchase: Creem collects the payment, calculates and remits applicable sales tax or VAT, issues your receipt and handles payment disputes. Your card statement will show a charge from Creem.

Purchases are tied to the copy of the application installed on your device. If you replace your computer, contact us and we will help you restore your purchases.

We may change prices at any time. A price change never affects a purchase you have already completed.

4. Refunds

You may request a full refund within 14 days of purchase, no questions asked. See the Refund Policy for how to request one.

5. Acceptable use

You agree not to use the Service to:

• break any applicable law or regulation;
• infringe the rights of others, including intellectual property and privacy rights;
• interfere with, overload or attempt to gain unauthorised access to our servers or another user's device;
• circumvent payment or licensing, for example by sharing purchased content files or fabricated order identifiers.

6. Content and updates

The Service may download additional content (for example artwork packs, wallpapers or content lists) from our servers. We may add, change or remove such content, and may release updates, at any time. We are not obliged to provide any particular content or to continue supporting a particular operating system version indefinitely.

7. Intellectual property

The Service, including all artwork, animation, audio, text and software, is owned by us or our licensors and is protected by copyright and other laws. These Terms do not transfer any ownership to you; they only grant the licence described in section 2.

8. Availability

The application is designed to work offline. Online features - purchases, content downloads and update checks - depend on our servers and on third-party services, and may occasionally be unavailable. We do not guarantee uninterrupted availability of those online features.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free or that it will run on every hardware or software configuration.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

11. Termination

You may stop using the Service and uninstall it at any time. We may suspend or terminate your licence if you materially breach these Terms. Sections that by their nature should survive termination - including sections 7, 9, 10 and 12 - will survive.

12. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law rules. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when. Material changes will apply from the date they are published on this page. If you continue to use the Service after a change, you accept the updated Terms.
